Brad Stone brought this action against Chelan County and the Chelan County Sheriffs Department alleging he was wrongfully denied employment because he refused to take a polygraph examination, in violation of RCW 49.44.120. The question presented is whether a city law enforcement employee who requests transfer of employment to the county sheriffs office pursuant to RCW 41.14.250-.270 is "making initial application for employment" so as to fall within an exception to RCW 49.44.120, which prohibits requiring lie detector tests as a condition of employment. The trial court answered in the affirmative and granted the County summary judgment. We affirm.
